New state aid scheme for rent defaults (RD 1135/2025)

ROYAL DECREE 1135/2025, OF 10 DECEMBER, ESTABLISHING THE CONDITIONS FOR STATE-FUNDED AID TO COVER NON-PAYMENT OF RENT FOR YOUNG PEOPLE AND VULNERABLE GROUPS.

The Official State Gazette (BOE) has published Royal Decree 1135/2025, of 10 December, which regulates a line of state aid to cover non-payment of rent for homes leased to young people and vulnerable groups. The measure, in force from the day following its publication, will be managed by the autonomous communities and the cities of Ceuta and Melilla, and may be implemented through public guarantees, insurance, subsidies or other equivalent mechanisms.


The coverage guarantees landlords, whether individuals or legal entities, the collection of unpaid rent and utilities, damage caused to the property and, where applicable, insurance premiums for non-payment. It will apply to contracts in force on 30 January 2025 or signed thereafter.


Who can apply for the aid?


Landlords who meet the requirements established by regional regulations and can prove that they are up to date with their tax and social security obligations may apply. Likewise, the autonomous communities and cities of Ceuta and Melilla may be beneficiaries with regard to the non-payment insurance premiums they take out as policyholders, but insurance companies may not be beneficiaries.


The funding will come from the 2026-2028 General State Budget, without advance payments, and the scope of application is the entire national territory, except for the Basque Country and Navarre. The measure reinforces the legal security of landlords and encourages renting to groups with greater difficulties in accessing housing.
